Introduction

Terms of use for VO Staffing website- This is a VO Staffing website or a VO Staffing affiliate website. As a user of this Website, or by logging into a VO Staffing online portal, you are deemed to accept the following terms and conditions. These terms will be mutually applicable whenever you use this Website or access a VO Staffing online portal.

The VO Staffing Site provides simple, cost-effective, and convenient services, including:

  • Provider(s) advertise Offer(s) and Candidate(s) can search and apply for Offer(s);
  • Client seeking services in applications, software, solutions, and services can seek our services as per agreed on the agreement.

This page and other pages on the Site (Terms) apply to you if you access, use, link to, use the software on or download software from the Site. You agree to accept and comply with these Terms visible on VO Staffing site.

The terms (User, you, and your) are binding on you if you access and/or use the Site.

Consumers' statutory rights are not affected by the Terms.

Definitions

These terms have the following meanings unless otherwise specified in the Terms:

  • Candidate refers to a User who submits an Offer application through the Site.
  • The Casual Employment Agreement is the agreement between an employee and VO Staffing.
  • The term "employee" refers to a casual employee of VO Staffing who may accept offers through the Site.
  • A Job refers to the labour services that the Candidate will provide to a Provider, as per the subject of the Offer.
  • Candidate Job Confirmation refers to the electronic receipt showing that the Provider has accepted the Candidate's Application for an Offer.
  • An Offer is a conditional agreement by the Provider to hire or employ a User for a Job/, advertised on the Site or in other ways.
  • Payment is a remuneration that the Provider pays to the Candidate for the Job.
  • A provider is a person who makes the job Offer available.
  • A client is a person, company, or entity that agrees to take our services or solutions from the software or application category.

As long as Users comply with the Terms, the Site is free to use.

A Provider may pay VO Staffinga commission if:

  • Candidate clears the recruitment process when referred by us.
  • The Provider hires or employs a User for a Job provided to them via VO Staffing.

The Providers determine the remuneration for Jobs posted on VO Staffing. Providers and VO Staffinghave a responsibility, in the case of employees only:

The Terms and Conditions of the Offer must comply with all applicable laws, including but not limited to the Competition and Consumer Act 2010 (Cth), the Fair Work Act 2009 (Cth), the Privacy Act 1988 (Cth), and the Human Rights and Equal Opportunity Commission Act 1986 (Cth);

  • Make sure that the terms and conditions of the Offer are consistent with applicable awards or enterprise agreements, or the national minimum wage for junior employees outlined in the national minimum wage order; and
  • Pay the Australian Tax Office, by Pay As You Go (PAYG) withholding, all mandatory contributions, including superannuation guarantee payments, if permitted by law.

User Warranty

User warrants that:

  • When they accept an offer through the Site, they have the relevant qualifications, including any mandatory qualifications and memberships required to perform the Job and are Australian residents or have some other legal right to perform the Job in Australia; and

The way VO Staffing uses your personal information.

The use of your personal information by VO Staffingis governed by the company's Privacy Policy. It is important that you carefully read the Privacy Policy, as it contains important terms that apply to you and your personal information.

The process of forming a job contract

As soon as you apply for an Offer through the Site (Application), you will receive a notification (i.e. an email, a push notification, or an SMS, which will acknowledge our receipt of your Application). It does not necessarily mean that you are the selected or eligible candidate. Application acceptance by the Provider will only occur in accordance with the process outlined below.

  • A confirmation will be sent to you if your application is accepted.
  • An Application can be canceled up until the moment when it is confirmed.
  • Only If VO Staffing sends you a confirmed contract (Contract), the contract between VO Staffing, you, and/or the Provider is formed.
  • Any Application and any Offer may be rejected by VO Staffing or the Provider depending on the Terms. VO Staffing reserve the right to refuse an application on behalf of the Provider if we believe that the Application will be declined by the Provider.
  • VO Staffing will notify you if an Offer has been withdrawn for any reason pertaining to an Application you have made.
  • A Job confirmation may have to be canceled or rescheduled due to circumstances beyond VO Staffing control. The new date for the Job will be notified to you by VO Staffing in the event that a Provider reschedules the Job. When the rescheduled date is not convenient for you, VO Staffing will cancel the Confirmation, rescinding the Contract.

Confirmations and Applications

VO Staffing strives to work with reputable Providers, but VO Staffing accepts no responsibility or liability regarding the Offering, including the performance of the Job, except when agreed upon with an Employee under a Casual Employment Agreement.

As long as an Employee has not entered into a Casual Employment Agreement:

  • Training, workplace safety, and payment are all responsibilities of the Provider;
  • The Provider should be contacted with any questions regarding the Offers displayed on the Site; and
  • If there is a dispute between you and the Provider, it will be resolved between you and the Provider.

Intellectual Property

VO Staffing owns, controls, or licenses all text, graphics, user interfaces, photographs, trademarks, logos, and artwork, including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such content, on the Site. Copyright laws, patent laws, trademark laws, and various other intellectual property laws protect all of these

All information on the Site should be used only for personal, non-commercial information purposes. It is forbidden and illegal to copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit or distribute any content on the Site to any other computer, server, website, or another publication or distribution medium or for any commercial enterprise without taking prior written permission from VO Staffing.

Review and Ratings The Site offers Users the opportunity to comment on their experience with:

  • Job(s) sourced; or
  • Experience with VO Staffing

Users can only post one (1) review per job or service

  • There are no opinions or recommendations contained in the Reviews on the Site. Review(s) visible on VO Staffing site should not be relied upon to make (or refrain from making) or take (or refrain from taking) any action in any condition at any time.
  • Reviews are the opinions of users, visitors of the site and any statements, advice, or opinions posted by such users are solely their own and not VO Staffing.
  • VO Staffing may include or exclude any Review as it deems necessary, subject to Australian Consumer Law, It may stop all usage to protect Providers, Users, and other site users from inappropriate content, which can result in termination of accounts as well.

The integrity of the Site is ensured by VO Staffing by not removing or editing Reviews where doing so would be in violation of the Australian Consumer Law.

Review of Transmissions

By submitting Reviews, suggestions, comments, questions, or posting any other content on the Site, you agree to grant VO Staffing an unrestricted, perpetual, royalty-free, worldwide, fully sublicensable right to use, reproduce, modify, translate, adapt, publish, create derivative works, distribute and display such content regardless of the format or technology being used.

Neither VO Staffingnor any of its users are responsible nor liable for any content posted or submitted by you or others. You warrant to VO Staffing that all materials posted or submitted by you to the Site conform to all laws and do not violate any person's intellectual property rights, and you agree to protect VO Staffing against any claim made as a result of your breach of that promise, including bearing legal fees on an indemnity basis.

Disclaimer of Warranty

VO Staffing provides the Site and its contents on an “as is” basis and use of the Site are at your own risk. All content is believed, in good faith, to be accurate, complete, current, and reliable at the date the information was placed on VO Staffing Site. VO Staffing, its directors, officers, employees, or agents do not represent or warrant that the information on the Site is accurate, complete, current, or reliable in relation to any goods or services displayed on the Site at any time under any situation.

Any directors, officers, employees, or agents of VO Staffing or any of them shall not be responsible in any way (including through negligence) for errors in, or omissions from, the information presented on the Site if found cannot be used in the legal cases.

To the extent permitted by law, VO Staffing expressly disclaims all warranties of any kind, whether express or implied, including (without limitation) implied warranties or conditions of merchantability or fitness for purpose.

Limited Liability

To the maximum extent permitted by law, VO Staffing or any of its directors, officers, agents, employees, or contractors shall not be responsible for any direct, indirect, special, or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort, or otherwise.

The site User may be bound by additional terms and conditions imposed by Providers. You will see these additional terms on the Site, the Job Confirmation, and the Enrollment Confirmation. VO Staffing is not responsible if you have a complaint or dispute with a Provider or employee. All Offer(s) are prepared by the Provider and handled by the provider only.

Upon completion of any task, Bezettten reserves the right to process a refund to the Payment Card used for the original payment. If bank refunds are delayed by inter-bank processing, VO Staffing will not be held responsible.

Release and Indemnity

VO Staffing and its officers, directors, agents, and employees will be held harmless from and against any claims, demands, proceedings, losses, and damages (actual, special, and consequential) of whatever kind or nature, known or unknown, including legal fees, made by any third party due to or arising out of your breach of the Terms and conditions.

Restrictions on Use

The Site is intended for use only by individuals located in Australia, and VO Staffing makes no representation that any material or function on the Site is appropriate for use in any other jurisdiction.

You warrant that any personal information you submit to the Site will be true, accurate, current, and complete in all respects. If you change any personal information, you will immediately notify VO Staffing of those changes by updating your Account details on the Site or by contacting VO Staffing via the communication mode presented on the site.

By using the Site or creating an Account, you agree not to impersonate any other person or entity. You also agree not to use any false names or names that are not authorized for use on the Site.

Third-Party Websites

There may be links on the Site to websites operated by third parties (Linked Websites). VO Staffing does not control the Linked Websites and is not liable for their content, practices, or availability. VO Staffing does not endorse, sponsor, or affiliate itself with any of the Linked Websites. Links to these sites are provided solely for your convenience. VO Staffing will not be held responsible or liable for any loss or damages resulting from your access or use of Linked Websites, including any reliance on content, goods, or services found on such Linked Websites under any condition or situation.

Unless VO Staffing agrees in writing, you may not link to the Site from any other website.

Relationship between the parties

It is understood that neither VO Staffing nor the User are authorized to bind each other, and that nothing in this Agreement can be construed as creating an employment, agency, partnership, fiduciary or joint venture relationship between them.

Usage that is not authorized

You may not use the Site or your Account for any illegal or unauthorized purpose, including transmitting any unlawful, libelous, threatening, abusive, harmful, obscene, or otherwise objectionable material, in any way that constitutes a criminal offense, that may result in civil liability or otherwise violates any laws, regulations or codes of practice.

Hacking, spoofing, or any other method of gaining unauthorized access to the Site is strictly prohibited on VO Staffing Site. Interfering with other people's use or enjoyment of the Site, damaging, disabling, or impairing the operation of the Site is strictly forbidden if found could be exercised against you legally.

Termination and breach

You may be terminated from your Account, denied any new User registration, deny your linkage right to the Site, have an Application canceled, and/or prevented from using the Site in any further capacity if you violate any of these Terms explained. VO Staffing may take any action necessary to avoid liability or loss to Providers, or any employee if we believe there is a risk of liability or loss.

Persons with suspended or terminated accounts are not permitted to place or attempt to place Applications, or re-join the Site without VO Staffing's prior written consent, which may be withheld at VO Staffing's sole discretion only.

When a suspected breach of these Terms is suspected, VO Staffing reserves the right and the ability to trace your IP address and, if necessary, to contact your internet service provider.

Policy on cookies

Additionally to the personal information which you may provide directly to VO Staffing, VO Staffing may collect information from you through cookies on the Site.

'Cookies' are small text files that are placed on your computer's hard drive, through which VO Staffing accesses them every time you visit the Site. In this way, VO Staffing is able to obtain information about how the Site is being used. VO Staffing may use cookies for many purposes, including remarketing across the internet through Google Adwords, maintaining website security, monitoring website traffic, measuring website performance, and improving navigation. By using VO Staffing, you or any other user cannot be tracked.

Availability

There may be times when the Site is unavailable, including for maintenance and upgrades. The Site and its services are subject to discontinuation at any time, at the sole discretion of VO Staffing, and VO Staffing will not be held responsible, nor is it guaranteed, that the Site will be unavailable in advance.

Assignment

VO Staffing reserves the right to subcontract its obligations or rights under these Terms.

Any right or obligation under these Terms of the Offer may not be assigned, novated, or encumbered without VO Staffing's prior written consent.

Legislation that governs

All use of the Site is subject to the Terms, which are governed by the laws of Australia. The Site can be accessed throughout Australia and overseas. The content of our Site does not comply with the laws of other jurisdictions (including intellectual property laws). Those outside Australia who access the Site do so at their own risk and are responsible for making sure that all laws in the country they are visiting are being respected.

VO Staffing reserves the right to modify these terms at any time

The offer will be subject to the Terms in effect at the time you submit a request for the task via the Site.

VO Staffing may revise these Terms in response to changes in applicable laws and regulatory requirements. VO Staffing will inform you in advance if these Terms have to be revised as they apply to a Job, and how you can cancel the Confirmation.
